Who is liable when electrical equipment goes wrong? Many organisations don't realise they are themselves responsible.

Many organisations don't know that they are responsible

Organisations often have no idea who has responsibility for electrical equipment, with all the attendant risks. If you have not set this down in writing, or not clearly, you are not meeting the statutory requirements. It also means your insurance company may refuse any liability claim.

Working Conditions Decree:

"Work equipment that is subject to influences leading to deterioration which may give rise to dangerous situations shall be inspected as often as necessary to ensure good working condition, including testing if necessary."

NEN 3140:

"Electrical work equipment must demonstrably undergo professional periodic inspections. That goes from the tools in the factory or workplace to the coffee machine and radio on the windowsill."

Some examples; Everything with a power cord

  • Electric hand tools;
  • Movable electrical tools;
  • Hand lamps, other movable lamps;
  • Refrigerators, coffee makers, etc.;
  • Cable reels, extension cables


In short: 'All devices that employees come into contact with in the course of their business and to which a plug is attached.'
